Well, as hard as it is to believe that it is possible to overreact
to the wording, you have I'm afraid, though I don't blame you for
believing the very worst!

If nests were found during the current nesting season, the stand
won't be cut during the current year (not just the three or so
month breeding season).

But, if a nest can't be found the next year, it will be cut.

(actually, under the law it MUST be cut, and during that year - otherwise
the effing little birdies might build their nest someplace where it
will be found, gawdammit!)

Also, do keep in mind that this only applies to Section 318 sales.

The rest of westside forests will be managed according to the
Clinton Forest Plan (which starts to look better and better, kind
of like a rotting side of beef after a few weeks of starvation). But
the law in its final form did contain the mandate to
meet the cut goals stated in that plan.

In other words, the plan sets out a management plan and predicts
an amount of timber which should be produced by following it.
The new law requires that amount to be harvested, meaning that
the cut comes before the plan. It also insulates the plan from
challenge, of course.
