True. I wasn't intending to cede the point that all cases I'm aware
of have turned out NOT to be screw-ups. Perhaps I should've made
it clear by saying "Even if this case is a screw-up, do we use..."

Dale also informed me privately that there have been several convictions
under the ESA. Perhaps Ralph Maughan stated that it was the second
conviction under a particular section, something like that. I'll
assume I simply misunderstood his words, since I'm reknowned for
my ability to do so :)

Thanks for the sturgeon info, as well - one more factoid to file.
