You're probably right, I'd have to check the regulations - although, if
there are no eggs and it's not an endangered species, I doubt much
enforcement would be done. Besides, it's been my experience that legality
has very little impact (unfortunately) on anyone worrying about bird poop.
Public opinion has a much better effect (take the great Eugene Airport faux
paux a couple of years ago).

Actually, if it was a busy location (alot of human traffic), it may be a
moot point. We had tree swallows nesting over the back door year before
last. It was a busy location and there were several near misses as we came
out the door and almost collided with an adult leaving the nest. They
returned the following year and checked out the location but decided they
didn't want that location after all and nested elsewhere.
