Banders can legally band anything their permit allows them to band.

The issue is more one of common sense and good manners, not the legal
right to band the bird in question (I assume that FRG's banding
permits, federal and state, are broad enough to allow it).

Thus far, in this country, it is difficult if not impossible to win
a judgement against a defendent merely based on a display of poor
manners - it is necessary to prove actual harm.
