This seems to be the general consensus, based on: small and dark, long tail,
pointed wings, rapid wingbeats, no white patches, sits upright in the top of
trees.

Very un-hawklike wings; too small for a Peregrine.

Hey, I'll take a downtown Merlin any day! Never identified one of those,
either.
