Subject: Herons Forever: How to respond to the developer's appeal of the Hearing Examiner's decision

We received the developer?s appeal of the hearing examiner?s decision
this week. Several of you have written to ask if your comments are needed
in response to this appeal.

Our attorney informed me that our comments should be based on the hearing
record. We need to show that the developer is misrepresenting the facts
presented at the hearing. Only our attorney and a few of our experts will
be able to respond in this manner. The deadline for our response to this
appeal is Thursday, September 2.

The next important date is October 21, 2004, when the Renton City Council
hears the developer?s appeal. We will keep you posted as this date
approaches.

I appreciate your commitment to Herons Forever as we work to save the
Black River heron colony. The best way to support us right now is by
contributing financially to help pay our mounting legal fees. We need
your help.

100% of all gifts made to Herons Forever goes toward our legal effort to
make sure the Hearing Examiner?s decision is retained. Please consider a
contribution of at least $35. If you are able to give more, we would be
very grateful, as it will help make up for those who cannot.

All of us with Herons Forever are volunteers. There is no overhead.
Herons Forever is the only environmental organization dedicated solely to
protecting the Black River Riparian Forest and great blue heron colony,
the largest heron colony in the tri-county region (King, Snohomish, and
Pierce). We are an incorporated non-profit with over 450 members.
