This is based on a statement by DOD laywer and eventual
Bush judicial nominee William Haynes II who suggested:

that bombing the bird haven [the Marianas] would not break the
[International Migratory Bird] treaty and that the bombing would
actually enhance bird-watching because people "get more enjoyment
out of spotting a rare bird than they do spotting a common one."
