When trying to identify a small flycatcher, it's easy to get distracted by the difficulty of identifying Empidonax to the point of forgetting one other option. It's happened to me. What's the other option? Wood-Pewees. I believe the bird in the photos is a Western Wood-Pewee based on coloration (no yellow or green, just gray), no discernible eyering, and to a lesser extent, body shape and it's choice of a perch.
