It also appears mergansers are protected under the Migratory Bird Act: Section 703 of Title 16, Chapter 7 of the United States Code: Protection of Migratory Game and Insectivorous Birds.

(For law enforcement, besides jurisdiction issues [county vs. feds.], sometimes for the officer to enforce he/she must witness the violation. Otherwise a citizen's arrest is required. Not saying it is applicable in this case - just an observation. In either case, though, the citizen's arrest should have been offered to you or referral to federal authority should have been made {I think]. If the shooter had the bird in his possession ....?)
