Even though Ospreys are not currently considered endangered or threatened
under U.S. Endangered Species Act, they are protected under Migratory Bird
Treaty Act of 1918, which makes it illegal for people to "take" migratory
birds, their eggs, or feathers.

If the nest was removed prior to the Osprey nesting, then there would be no
legal violation of the treaty; however if the nest was removed with eggs in
it, then that would be a serious violation and the owner of the tower would
be subject to some serious fines.
